DMCA / COPYRIGHT POLICY

1. OVERVIEW
BetterAuth respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service.
This policy describes how copyright owners or their authorized agents can report alleged infringements, how users can respond with counter-notifications, and our procedures for handling such claims.
2. REPORTING COPYRIGHT INFRINGEMENT
If you are a copyright owner (or authorized to act on behalf of a copyright owner) and believe that any content on or accessible through the BetterAuth platform infringes your copyright, you may submit a written DMCA takedown notice to our designated DMCA Agent.
Upon receipt of a valid DMCA notice, we will:
- Take reasonable steps to promptly notify the affected user that material has been removed or access has been disabled.
- Remove or disable access to the allegedly infringing material.
- Maintain a record of all DMCA notices received and actions taken.
We reserve the right to reject or ignore incomplete or invalid DMCA notices.
3. DMCA TAKEDOWN NOTICE REQUIREMENTS
To be valid, your DMCA takedown notice must include the following elements:
- Identification of the copyrighted work that you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material — including the specific URL, application name, or other sufficient detail to allow us to locate the material on our platform.
- Your contact information — including your full name, mailing address, telephone number, and email address.
- A statement of good faith — "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- A statement of accuracy — "I swear, under penalty of perjury, that the information in the notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not submit false claims.
4. COUNTER-NOTIFICATION PROCEDURE
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be valid, your counter-notification must include:
- Identification of the removed material and the location where it previously appeared.
- A statement under penalty of perjury — "I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal court in your district (or the district where your address is located, if outside the United States), and that you will accept service of process from the person who submitted the original DMCA notice.
- Your name, address, telephone number, and a statement consenting to jurisdiction.
- Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the copyright owner does not file a court action within 10–14 business days, we will restore the removed material.
5. REPEAT INFRINGER POLICY
In accordance with the DMCA and other applicable laws, BetterAuth has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.
A "repeat infringer" is a user who has been subject to two or more valid DMCA takedown notices. We will:
- Maintain a record of all valid DMCA notices associated with each account.
- Issue a warning after the first valid notice.
- Suspend or permanently terminate the account after the second valid notice, depending on the severity of the infringement.
We also reserve the right to terminate accounts immediately in cases of egregious or willful infringement, regardless of prior history.
